Terms of Service for GUNSENS INC

Effective Date: October 1st, 2023

1. Acceptance of Terms
   1. By purchasing the GUNSENS Sensor and/or subscribing to the GUNSENS Cloud service, you agree to the terms and conditions listed here.
2. Description of Product
   1. GUNSENS INC provides a shooting threat detector device ("GUNSENS Sensor") and a related software as a service subscription ("GUNSENS Cloud"), collectively, the "GUNSENS Product".
3. Usage Limitations
   1. The GUNSENS Product is intended for lawful purposes only. Misuse may result in termination of the GUNSENS Cloud subscription and potential legal action.
4. Monitoring Subscription
   1. Monitoring Subscription requires monthly or annual payments. Failure to make timely payments will result in service suspension.
5. Warranties and Liability
   1. GUNSENS INC does not guarantee 100% accuracy in detection and cannot be held liable for any damages or injuries resulting from misinterpretations or malfunctions of the GUNSENS Product.
6. Termination
   1. GUNSENS INC reserves the right to terminate the GUNSENS Cloud subscription for any user found to be in violation of these terms.
7. Data Privacy
   1. Data collected through GUNSENS Cloud will be stored securely and will not be sold or shared with third parties without user consent, except as required by law.
8. Preorders
   1. Preorder Commitment:
      1. By placing a preorder for the GUNSENS Product, you are committing to purchase the GUNSENS Product at the stated price. You'll be charged upfront, even if the GUNSENS Product will be shipped at a later date.
   2. Expected Shipment Date:
      1. While we strive to meet our projected shipment dates, these are estimates and subject to change. We will endeavor to communicate any significant delays to our preorder customers.
   3. Refunds and Cancellations:
      1. Preorders can be canceled and refunded up until 30 days before the estimated shipping date. After this point, cancellations may be subject to a restocking or administrative fee.
      2. In the event we cannot fulfill your preorder (e.g., due to production issues), you will be notified and given a full refund.
   4. Pricing:
      1. The price paid at the time of the preorder is final. If the retail price changes before the product ships, preorder customers will not be charged extra nor given a refund for the difference.
   5. Updates and Communication:
      1. We are committed to providing updates on the production and shipping status of preordered products. Please ensure your contact information is up to date so you can receive these notifications.
   6. Final Product:
      1. While we aim to deliver a GUNSENS Product that closely matches descriptions and promotions, the final GUNSENS Product may have minor differences due to manufacturing or design refinements.
   7. Limitations:
      1. GUNSENS INC reserves the right to limit the number of preorders, both per customer and overall. We also reserve the right to cancel preorders if necessary, in which case a full refund will be provided.
9. Refunds
   1. Device Refunds
      1. Customers may request a refund for the GUNSENS Product within 30 days of the original purchase date.
      2. To qualify for a refund, the GUNSENS SENSOR must be returned in its original condition, with all included accessories and packaging. Any damage or missing components may result in a partial refund or denial of the refund request.
      3. Customers are responsible for return shipping costs, unless the GUNSENS Sensor arrived damaged or defective.
   2. Subscription Refunds
      1. Customers may request a refund for the GUNSENS Cloud subscription within 14 days of the start or renewal of the subscription period.
      2. Refunds for subscriptions will be prorated based on the number of days the service was active. For example, if a customer requests a refund 10 days into a monthly subscription, they will be refunded for the remaining 20 days.
   3. Processing of Refunds
      1. Once the return is received and inspected, an email notification will be sent to the customer regarding the status of the refund.
      2. Approved refunds will be processed, and a credit will be applied to the original method of payment within a certain number of days, depending on the payment provider.
   4. Exceptions
      1. Refunds outside of the stated time frames (30 days for GUNSENS Sensors and 14 days for GUNSENS Cloud subscriptions) are at the sole discretion of GUNSENS INC and may be subject to a restocking or administrative fee.

10. Updates and Modifications
    1. GUNSENS INC may update the GUNSENS Sensor firmware and software. Users may be required to update their GUNSENS Sensors for continued optimal performance.
11. Indemnification
    1. Users agree to indemnify and hold harmless GUNSENS INC from any claims or damages resulting from their misuse of the GUNSENS Product.
12. Governing Law
    1. These terms shall be governed by the laws of Florida, without regard to its conflict of laws principles.
